2. Object
These Conditions of Contract regulate the commercial relationship between RKM Balearic Sports, S.L. (hereinafter, “Rutas Kayak Menorca”) and the client who contracts any of the services offered through the website www.rutaskayakmenorca.com.
The services offered are:
- Guided kayak tours (Cave Route from Cala en Porter and from Es Canutells).
- Kayak rental unguided.
3. Recruitment process
The contracting of services through www.rutaskayakmenorca.com follows the following steps:
- The customer selects the desired service (guided tour or rental), date, time and number of participants.
- The customer reviews the summary of his booking, including the total price including VAT.
- The customer pays 100% of the total amount to confirm the booking.
- Once the payment is completed, the client receives a confirmation email with the booking details (service, date, time, location and number of participants).
The booking is only confirmed upon receipt of full payment. The confirmation email constitutes proof of booking.
4. Prices and payment
All prices indicated on the website include VAT. Rates are per person, unless otherwise indicated for groups on a personalised quotation.
The price includes: kayak, life jacket, paddle, waterproof canister and qualified guide (on guided routes). The hiring of external services (accommodation, transport, etc.) will be at the client's expense.
Payment is made in full at the time of booking via the payment gateway available on the website.
5. Participation requirements
5.1. General requirements (applicable to all activities)
- It is essential to know how to swim.
- Maximum recommended weight: 100 kg. Maximum recommended height: 2 m. If these values are exceeded or equalled, please consult the centre in advance.
- The client must inform prior to the contracting of any disability, relevant pathology or pregnancy status. Pregnant women need express permission from their doctor.
- It is forbidden to participate under the influence of alcohol, drugs, narcotics or any medication that may affect the ability to react.
- It is the client's responsibility to travel to the meeting point of the activity.
5.2. Age requirements (guided tours - Cave Route)
- Children under 6 years old: not allowed in Cala en Porter. In Es Canutells, the minimum age is 7 years old.
- From 6 to 7 years old (included), in Cala en Porter: when they go as the third occupant of the kayak, their place is free (maximum one child of this age per kayak). If they occupy a separate seat, they pay the child rate.
- Children under 14: must be accompanied by a responsible adult.
- From 14 to 17 years old: they can participate without an accompanying adult, but they need an authorisation signed by their parent or legal guardian.
- Parents or legal guardians are responsible for minors participating in any activity, whether or not they themselves participate, and must have given their express consent.
5.3. Equipment and personal belongings
The kayaks used on the guided routes are double kayaks (with the possibility of single kayaks), open (sit on top) and self-bailing. Before each trip, the guides explain the basic paddling technique. No previous knowledge is required, but an average level of fitness is required.
All personal items carried on board (mobile phone, camera, glasses, clothes, etc.) are the sole responsibility of the client. Rutas Kayak Menorca is not responsible for their loss, damage or deterioration, whatever the cause, and under no circumstances will compensation or indemnity be payable for this concept. It is recommended not to carry valuables during the activity.
6. Obligations of the customer
By contracting any service from Rutas Kayak Menorca, the client undertakes to:
- Comply with all the participation requirements set out in section 5.
- Follow the instructions of the guide or monitor responsible for the activity at all times.
- Be at the meeting point at least 25 minutes before the start time. In case of late arrival, the group may leave without the client and no refund will be made.
- Acceptance of the Liability Clauses. The client accepts them by means of the obligatory checkbox in the online booking process or, in the case of on-site contracting, by paying for the service.
7. Insurance
The guided routes include the compulsory accident insurance and civil liability insurance for canoeing activities in the Balearic Islands, in accordance with current regional regulations.
Supplementary travel or personal medical insurance is recommended for all clients, especially international clients.
8. Responsibility
Rutas Kayak Menorca is liable for damages that are a direct consequence of negligence on the part of the company or its guides during the contracted activity.
The responsibility of Rutas Kayak Menorca is limited to the period of the contracted activity, from its beginning to its end.
Rutas Kayak Menorca shall not be liable for damages arising from:
- Failure by the client to comply with the guide's instructions or participation requirements.
- Concealment by the client of medical, physical or other conditions relevant to the activity.
- Weather or sea state conditions, within the safety margins assessed by the team.
- Reckless or reckless behaviour by the client during the activity.
9. Specific conditions for kayak rental
When the customer hires the kayak rental without a guide, he/she accepts the following additional conditions:
- The customer assumes full responsibility for his own safety during the rental period.
- The client is aware that sea kayaking involves certain risks and undertakes to bear them in mind during use.
- The equipment must be returned in the same condition in which it was delivered. If the equipment is not returned within the agreed period or is damaged, Rutas Kayak Menorca reserves the right to claim the costs corresponding to the delay or repair.
- The rental fee is not refunded if the weather conditions are not to the client's liking (rain, wind, etc.), as long as Rutas Kayak Menorca has assessed that the conditions allow the activity to be carried out safely.
10. Cancellation policy
This same cancellation policy is available separately at Cancellation policy.
10.1. Weather conditions and sea conditions
Our activities are subject to weather conditions and sea conditions. For this reason, RKM Balearic Sports, S.L. (Rutas Kayak Menorca) may modify or cancel the activity, even during its development. In this case, the client will have the right to reschedule the activity or receive a refund of the amount paid.
10.2. Cancellation and modification of services
The customer may cancel or modify the contracted services and shall be entitled to a refund of the amounts paid, subject to the following penalty criteria:
- Cancellation less than 3 days in advance: penalty of 100% of the total amount of the reservation.
- Cancellation more than 3 days in advance: no penalty.
10.3. Dizziness
No refund will be made in the event of seasickness. As this is an activity in an environment with possible waves, the client is responsible for taking the necessary preventive measures, such as, for example, the use of Biodramine, in the event of being prone to seasickness.
10.4. Reactions of fear, anxiety or claustrophobia during the activity
No refund will be given in the event that the client experiences a sudden attack of fear, anxiety, claustrophobia or other similar reaction during the tour. The client must be aware of the nature of the activity, which takes place in the middle of the sea and enters sea caves, and take responsibility for their participation, especially when the activity is done with children.
10.5. Non-submission
Failure to show up at the date and time indicated by RKM Balearic Sports, S.L., will result in the client being obliged to pay the full amount of the booking.
10.6. Failure to show up with the full group
If the client makes a reservation for a group and does not show up with the number of people indicated in the reservation, RKM Balearic Sports, S.L. will not refund the amount, unless this has been communicated in advance.
10.7. Duplication of reservation
In the event of a duplicate booking and not notifying us at least 24 hours in advance, if the route is complete, no refund can be claimed. However, if the kayak is released and is occupied by another customer, the full amount will be refunded, regardless of the time elapsed.
10.8. Cancellation due to injury or illness
In the event that the client is unable to attend the activity due to injury or illness, it will be necessary to present a medical report justifying the impossibility of participating. Once the medical report has been received, and provided that the cancellation is made at least 24 hours before the date of the activity, the amount paid will be refunded.
If the booking is for a group, only the customer concerned and one accompanying person will be reimbursed. No refund will be made for the other participants in the group.
10.9. Right of admission
RKM Balearic Sports, S.L. reserves the right to refuse admission in the following cases: if the client is under the influence of alcohol or other narcotic substances, or if the booking has been made without complying with the essential requirement of knowing how to swim, as specified in the terms of contracting the service. In none of these cases will the amount paid be refunded.
10.10. Use of coupons and discounts
All coupons or discount codes must be previously validated by Rutas Kayak Menorca (RKM Balearic Sports, S.L.) in order to be applicable. In the event that a coupon is not validated or does not comply with the established requirements, the amount corresponding to the service will be charged without applying the discount.
10.11. Change of event date
A customer with a confirmed booking may request a change of date under the following conditions:
- Minimum advance notice of 3 days before the date of the event.
- Subject to availability.
10.12. Repayment period
Refunds are processed through the payment gateway and the amount is usually reflected in the customer's account within 7 to 14 working days, depending on the bank. If after this period the client has not received the refund, they should contact Rutas Kayak Menorca at [email protected] so that we can review their case.
11. Right of withdrawal
In accordance with article 103, section l) of Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users, the right of withdrawal is not applicable to contracts for the provision of leisure activity services when they refer to a specific date or period of performance.
Given that the activities of Rutas Kayak Menorca are contracted for a specific date and time, the 14 day right of withdrawal foreseen for distance contracting is not applicable. However, the client can cancel or modify their booking in accordance with the conditions indicated in section 10 and on the page of Cancellation policy.
12. Right of admission
Rutas Kayak Menorca reserves the right of admission and may refuse participation in the activity without the right to a refund in the following cases:
- The client is under the influence of alcohol, drugs or other substances.
- The client does not meet the requirement to be able to swim.
- The client has concealed a medical or physical condition that compromises his or her safety or that of the group.
- The customer does not meet the age, weight or height requirements stated in these conditions.
13. Intellectual and industrial property
All the contents of the website (texts, images, graphics, videos, logos, design and structure) are the property of RKM Balearic Sports, S.L. or are used under licence, and are protected by intellectual and industrial property legislation.
Rutas Kayak Menorca is a registered trademark with the Spanish Patent and Trademark Office (OEPM). Its reproduction, distribution, modification or use without express authorisation is prohibited.
Browsing the website does not grant the user any rights over the intellectual or industrial property of Rutas Kayak Menorca.
14. Data protection
The personal data provided by the client during the contracting process will be processed by RKM Balearic Sports, S.L. as the data controller, for the purpose of managing the booking and providing the contracted service. The legal basis for the processing is the execution of the contract.

15. Complaints and dispute resolution
Rutas Kayak Menorca provides customers with complaint forms at its facilities in Cala en Porter and Es Canutells, in accordance with the consumer legislation of the Balearic Islands.

16. Applicable law and jurisdiction
These Terms and Conditions are governed by Spanish law.
For any dispute arising from the interpretation or execution of these conditions, both parties submit to the jurisdiction of the Courts and Tribunals of Mahón (Menorca), expressly waiving any other jurisdiction that may correspond to them, unless the applicable consumer legislation determines a different jurisdiction.
17. Modifications
Rutas Kayak Menorca reserves the right to modify these Conditions of Contract at any time. The modifications will come into effect as soon as they are published on the website. Bookings confirmed prior to a modification will be governed by the conditions in force at the time of contracting.
The cancellation policy in force at the time of booking cannot be changed retroactively.
18. Acceptance
Making a reservation through www.rutaskayakmenorca.com or by any other means offered by Rutas Kayak Menorca implies full acceptance of the present Conditions of Contract.
If the customer makes a booking on behalf of other persons, he/she assumes responsibility for informing them of these conditions and guarantees that he/she has their consent.
