La utilización de la misma atribuye al navegante la condición de Usuario, lo que implica la adhesión y compromiso de cumplimiento de todas y cada una de las condiciones contenidas en este Aviso Legal, en la versión publicada en el momento en que se acceda al mismo, por lo que se recomienda al Usuario leer este Aviso Legal atentamente cada vez que acceda a la Sitio Web. Estas Condiciones serán aplicables con independencia de la existencia de otras condiciones específicas aplicables a determinados servicios que se presten en el Sitio Web.

Este Acuerdo de Condiciones de contratación (“Condiciones de contratación”) y nuestra Política de Privacidad, que se incorpora en este documento como referencia, se realiza entre usted y RKM Balearic Sports, S.L. Rige su uso de los servicios, información y productos disponibles a través del sitio web www.rutaskayakmenorca.com (“Servicios”). Al acceder y utilizar los Servicios, usted reconoce que ha leído, entiende y acepta estar sujeto a las Condiciones de Contratación y la Política de Privacidad, independientemente de si es un visitante o miembro registrado. Si no está de acuerdo con las Condiciones de Contratación o la Política de Privacidad, no puede utilizar ni acceder a los Servicios.

CONDICIONES Y REQUISITOS GENERALES

• Estos «Términos y condiciones» se aplican a cualquier reserva de nuestras actividades y artículos.

• Imprescindible saber nadar.

• Los menores de edad deberán estar acompañados por una persona responsable o llevar una autorización firmada por ésta.

• Menores de 6 años no admitidos.

• Peso inferior a 100 Kg; altura inferior a 2m (consultar con el centro en caso de tener un peso y/o una altura igual o superior a las indicadas).

• Informar previamente al centro en caso de sufrir alguna discapacidad, patología importante y posibles estados de gestación antes de contratar cualquier actividad.

Asimismo se compromete a no estar bajo los efectos del alcohol, drogas y/o estupefacientes, así como cualquier otro medicación que pueda incidir en su capacidad de reacción.

• El cliente, al contratar nuestros servicios, se compromete a seguir en todo momento las instrucciones del guía (monitor) responsable de cada actividad.

• RKM Balearic Sports, SL. o nuestros guías no pueden ser considerados responsables por daños personales, pérdida o daño del material, cuando esto es causado como consecuencia de un mal uso y/o no seguir instrucciones dadas.

• Imprescindible reserva previa para asegurar la plaza. Para confirmar una reserva, el cliente deberá abonar el 100% del importe total.

• RKM Balearic Sports SL se reserva el derecho a realizar cambios en el horario o cancelar cualquier actividad por causa de las condiciones meteorológicas y de seguridad.

• El compromiso de RKM Balearic Sports SL comienza en el momento de inicio de la actividad contratada.

• El contrato y responsabilidad de RKM Balearic Sports afecta exclusivamente al trabajo directo de sus técnicos y la organización de la actividad.

Mediante el pago de un alquiler o ruta se da por entendido que el cliente ha leído y acepta nuestros términos y condiciones.

• Es responsabilidad del cliente desplazarse hasta el lugar de la salida de la actividad.

• RKM Balearic Sports SL se reserva el derecho de admisión a cualquier persona que presente alguno de los criterios citados anteriormente.

• Nos reservamos el derecho de hacer cambios y ajustes a estos términos y condiciones sin notificación previa a cualquier cliente. Haremos todo lo posible para cumplir con los términos que se han acordado en la reserva. La política de cancelación no se puede cambiar.

• Recomendamos a todos los clientes a tener su propio seguro de viaje personal / médica.

• Para cualquier demanda o reclamación contra RKM Balearic Sports SL se llevará a cabo en los juzgados y tribunales de Mahón.

• Las tarifas son por persona (excepto tarifas a medida para grandes grupos) y con IVA incluido. Este precio incluye el equipamiento técnico necesario y de seguridad: kayak, chaleco, pala, bolsa estanca (si la normativa COVID-19 lo permite), y guía titulado. La contratación de servicios externos (alojamiento, transporte…) será a cargo del cliente.

ALQUILER DE MATERIAL

• Para todos los alquileres, el siguiente escrito debe ser acordado:

«Por la presente declaro que tomo toda la responsabilidad por mi propia seguridad durante el período de alquiler. Soy consciente de que el kayak de mar tiene ciertos riesgos y tendré presente estos riesgos cuando esté en el agua. Devolveré el equipo en el mismo estado que cuando me lo dieron. Si el equipo no es devuelto dentro del período o está dañado de alguna manera, RKM Balearic Sports, SL. tiene derecho a reclamar los gastos extras de acuerdo con la demora o el mal estado del mismo.››

• No se devuelve el dinero o o se cancela la reserva de cualquier artículo o servicio alquilado si las condiciones climáticas no son del agrado del cliente (lluvia, viento, etc.).

• No se devolverá el importe de la pre-reserva una vez se haya efectuado.

CONDICIONES Y REQUISITOS DEL ALQUILER DE KAYAK DE MAR

RUTAS GUIADAS

• Los kayaks que se utilizan son kayaks dobles, con posibilidad de uno individual, abiertos (sit on top) y autovaciables.

• Durante todo el recorrido el grupo cuenta con la asistencia de guías-instructores titulados.

• El ejercicio de palear es muy sencillo y lógico, sin embargo, antes de salir al mar se hace siempre una explicación de la técnica básica para que cualquier participante pueda hacer todo el itinerario sin dificultades. Durante las excursiones se realizan diferentes paradas para descansar.

• Hay que estar en el lugar de encuentro 25 minutos antes de la hora de inicio de la actividad. Por favor asegúrate de estar en el lugar antes, ya que si se llega tarde, el grupo puede irse sin ti. Si esto ocurre no se devolverá el importe de la reserva.

No son necesarios conocimientos previos, pero sí se requiere condición física media para las excursiones guiadas de:

• RUTA DE LAS CUEVAS (3:00h)

CONDICIONES Y REQUISITOS

• Edad mínima para ir sin acompañante adulto:

– Ruta de Las Cuevas: Mínimo 14 años para ir solo

– Menores de 14 años acompañados de un adulto

– Menores de 6 años no admitidos

– De 6 a 7 años incluidos, no ocupan una plaza de kayak cuando es 3r ocupante, pero solo puede ir uno por kayak.

CONTRATACIÓN DE LAS RUTAS GUIADAS

1. Imprescindible reserva previa para asegurar la plaza.

2. Para la confirmación de la reserva, el cliente deberá abonar el 100% del importe total.

3. En el precio de las actividades guiadas está incluido el seguro de accidentes y de responsabilidad civil obligatorios para las actividades de piragüismo en las Islas Baleares.

• Son responsabilidad del cliente todos los objetos que se lleven a bordo sin la debida sujeción. Su extravío, ya sea por causas propias o ajenas, deja exento de responsabilidad y reclamación a RKM Baleraic Sports sobre cualquier compensación.

4. Desde la confirmación de la reserva el cliente asumirá de manera expresa la totalidad de las presentes Condiciones Generales. En caso de que una persona reserve en nombre de otra/s, este asumirá todas y cada una de estas Condiciones.

5. Mediante el pago de un alquiler o ruta se da por entendido que el cliente estará de acuerdo en aceptar la “Declaración de Responsabilidad” que verifican en el momento de la reserva.

POLÍTICA DE CANCELACIÓN

1- Nuestras actividades están sujetas a las condiciones meteorológicas y el estado del mar. Por este motivo RKM Balearic Sports, SL. (Rutas Kayak Menorca) puede verse obligado a cambiar o cancelar la actividad, incluido durante la realización de esta. En este caso el cliente tendrá derecho al aplazamiento de la actividad o la devolución del importe abonado.

2- El cliente podrá cancelar o modificar los servicios contratados teniendo derecho a una devolución de las cantidades abonadas pero se aplicarán los siguientes criterios de penalización:

• Desde 5 días antes o más, cancelación sin penalización.

• Entre 5 días y 72h antes está penalizado con el 30% del importe total de la reserva.

• Menos de 72 horas está penalizado con el 100% del importe total de la reserva.

4- No presentarse en la fecha y hora indicada por RKM Balearic Sports, SL., implicará la obligación, por parte del cliente, del pago del importe total de la reserva.

5- No se procederá a una devolución por mareo. Es una actividad en un medio con posible oleaje, el cliente debe ser el responsable de tomar las medidas necesarias, como, por ejemplo, el uso de Biodramina.

MODIFICACIÓN DE FECHA

El cliente con un reserva confirmada podrá realizar un cambio de fecha teniendo en cuenta los siguientes criterios:

This Terms of Service Agreement (“Terms of Service”) and our Privacy Policy, which is incorporated herein by reference, are entered into between you and RKM Balearic Sports, S.L. It governs your use of the services, information, and products available through the website www.rutaskayakmenorca.com (“Services”). By accessing and using the Services, you acknowledge that you have read, understood, and agree to be bound by the Terms of Service and the Privacy Policy, whether you are a visitor or a registered member. If you do not agree to the Terms of Service or the Privacy Policy, you may not use or access the Services.

GENERAL TERMS AND CONDITIONS

• These “Terms and Conditions” apply to any reservation of our activities and items.

• Swimming ability is mandatory.

• Minors must be accompanied by a responsible person or have a signed authorization from such person.

• Children under 6 years of age are not allowed.

• Weight must be less than 100 kg; height must be less than 2m (please consult the center if your weight and/or height is equal to or exceeds the indicated limits).

• Please inform the center in advance if you have any disabilities, significant medical conditions, or are pregnant before booking any activity.

You also agree not to be under the influence of alcohol, drugs, and/or narcotics, as well as any other medication that may affect your reaction capabilities.

• By hiring our services, the customer commits to follow the instructions of the guide (instructor) responsible for each activity at all times.

• RKM Balearic Sports, SL. or our guides cannot be held responsible for personal injuries, loss, or damage to equipment when caused as a result of misuse and/or failure to follow given instructions.

• Prior reservation is essential to secure a spot. To confirm a reservation, the customer must pay 100% of the total amount.

• RKM Balearic Sports SL reserves the right to change the schedule or cancel any activity due to weather and safety conditions.

• RKM Balearic Sports SL’s commitment begins at the start of the contracted activity.

• The contract and liability of RKM Balearic Sports solely apply to the direct work of its technicians and the organization of the activity.

EQUIPMENT RENTAL

• For all rentals, the following statement must be agreed upon:

“I hereby declare that I take full responsibility for my own safety during the rental period. I am aware that sea kayaking carries certain risks, and I will be mindful of these risks while on the water. I will return the equipment in the same condition as when it was provided to me. If the equipment is not returned within the agreed-upon period or is damaged in any way, RKM Balearic Sports, SL. has the right to claim additional costs based on the delay or poor condition of the equipment.”

• No refunds or cancellations of any rented item or service will be given if the weather conditions are not to the customer’s liking (rain, wind, etc.).

• The pre-booking amount will not be refunded once it has been made.

CONDITIONS AND REQUIREMENTS FOR SEA KAYAK RENTAL

GUIDED TOURS

• The kayaks used are double kayaks, with the option for one-person kayaks, open (sit on top) and self-draining.

• Throughout the tour, the group is accompanied by certified guide-instructors.

• Paddling is easy and intuitive; however, before heading out to sea, a basic technique explanation is always provided to ensure that every participant can complete the itinerary without difficulty. Different stops are made during the excursions for rest.

• Please arrive at the meeting point 25 minutes before the scheduled activity start time. Make sure to be there on time, as the group may depart without you if you are late. In such cases, the reservation amount will not be refunded.

No prior knowledge is required, but a moderate level of physical fitness is necessary for the guided tours:

CONDITIONS AND REQUIREMENTS

• Minimum age to go without an adult companion:

BOOKING GUIDED TOURS

  1. Prior reservation is essential to secure a spot.
  2. To confirm the reservation, the customer must pay 100% of the total amount.
  3. The price of the guided activities includes the mandatory accident and liability insurance for kayaking activities in the Balearic Islands.

• The customer is responsible for all objects brought on board without proper securing. Any loss, whether caused by oneself or others, exempts RKM Balearic Sports from any responsibility and claim for compensation.

  1. From the confirmation of the reservation, the customer expressly accepts all of these General Conditions. If someone makes a reservation on behalf of others, they assume all of these Conditions on behalf of the group.
  2. By making a rental or booking a tour, it is understood that the customer agrees to accept the “Declaration of Responsibility” verified at the time of reservation.

CANCELLATION POLICY

  1. Our activities are subject to weather conditions and sea state. For this reason, RKM Balearic Sports, SL. (Rutas Kayak Menorca) may be required to change or cancel the activity, including during its execution. In such cases, the customer will be entitled to reschedule the activity or receive a refund of the amount paid.
  2. The customer may cancel or modify the booked services and will be entitled to a refund of the amounts paid, but the following penalty criteria will apply:

• Cancellation without penalty is allowed 5 days or more before the activity.

• Cancellation between 5 days and 72 hours prior to the activity incurs a penalty of 30% of the total reservation amount.

• Cancellation less than 72 hours prior to the activity incurs a penalty of 100% of the total reservation amount.

  1. Failure to show up at the date and time specified by RKM Balearic Sports, SL. will result in the customer being obligated to pay the full amount of the reservation.
  2. No refunds will be provided for motion sickness. It is an activity in a potentially wavy environment, and the customer is responsible for taking necessary measures, such as using motion sickness medication.

DATE MODIFICATION

Customers with a confirmed reservation can request a date change according to the following criteria:

• 5 days or more before the event date.
