El cliente, con nombre registrado en la plataforma de reservas Turitop, SL utilizada por la empresa RKM Balearic Sports, SL, y actuando en nombre e interés propio y del grupo que representa bajo su reserva,
DECLARA
Primero.- Que alquila a la empresa RKM Balearic Sports, SL (Rutas Kayak Menorca), de Cala en Porter, material acuático consistente en embarcaciones tipo kayak y accesorios. Los términos del alquiler se refieren única y exclusivamente al material, que en ningún caso se entiende como un equipo completo para el desarrollo de la actividad, sino el simple alquiler de material individualizado, sin que pueda deducirse, en ningún caso, que exista por parte de RKM Balearic Sports, SL la obligación de instruir, asesorar, monitorizar, supervisar o cualquier otra forma de control y seguimiento, tanto de la forma de uso como del uso final de dicho material, ni responsabilidad alguna sobre el uso que efectivamente se le dé al material alquilado.
Segundo.- Que conoce cuál es la forma correcta de usar dicho material y cuáles son las medidas de seguridad para ese correcto uso. Por normas de seguridad se entenderán todas aquellas que se refieran tanto al uso del material como a la práctica de los deportes y actividades que con ese material se puedan llevar a cabo, sin límite alguno, en cuanto a la normativa, de carácter temporal, normativo, ámbito o naturaleza, siendo ese conocimiento tan amplio como en derecho sea posible.
Tercero.- Que se hace responsable de realizar el uso de dicho material de forma correcta, con arreglo a lo expuesto en el apartado anterior, librando de forma expresa de cualquier responsabilidad a RKM Balearic Sports, SL (Rutas Kayak Menorca), incluida la de recibir instrucciones de uso del material.
Cuarto.- Que la asunción de la responsabilidad la hace extensiva al uso que haga personalmente o cualquier otra persona, tanto si esta persona lo hace con su permiso y conocimiento como sin él y durante todo el periodo de tiempo en que dure el alquiler y hasta el momento en que retorne el material a RKM Balearic Sports, SL (Rutas Kayak Menorca), aun en el caso de que dicho retorno se produjera más allá del tiempo acordado de alquiler.
Quinto.- Que confirma que tiene el dominio básico de natación para poder realizar la actividad, requisito indispensable según la política interna de RKM Balearic Sports, SL. Si el cliente no cumple este requisito y, aun así, decide realizar la actividad, afirma que será bajo su estricta responsabilidad, liberando a la empresa de asumir cualquier responsabilidad, carga u obligación en cualquier situación en la que se precise dicha habilidad.
Sexto.- Que se responsabiliza de llevar el chaleco salvavidas durante toda la actividad, requisito indispensable según la política interna de RKM Balearic Sports, SL. Si el cliente no cumple este requisito y, aun así, decide realizar la actividad, afirma que será bajo su estricta responsabilidad, liberando a la empresa de asumir cualquier responsabilidad, carga u obligación en cualquier situación en la que se precise dicha habilidad.
Al aceptar estos términos, el cliente confirma que, tanto él como todos los miembros del grupo al que representa bajo su reserva, han leído y aceptado el acuerdo de responsabilidad e instrucciones de uso, con fecha del evento de la actividad y durante toda su duración.

The client with a registered name in the reservation platform Turitop SL, used by the company RKM Balearic Sport SL, and acting in his own name and interest and in the one of group that he/she represents under his reservation,
DECLARES
First.- That he/she rents to the company RKM Balearic Sports SL (Rutas Kayak Menorca), from Cala en Porter, water equipment consisting of kayak-type boats and accessories. The terms of the rental refer only and exclusively to the material, which is by no means understood as a complete equipment for the development of the activity, but a simple rental of individualized material, without being possible to deduce, in any case, that RKM Balearic Sports SL has the obligation to instruct, advise, monitor, supervise, or any other form of control and follow-up, the mode and way to use said material, nor any responsibility for the use that is finally given to the rented material.
Second.- That is aware of the correct way to use said material and what are the security measures for its correct use. Safety standards are understood to be all those that refer to both the use of the material and the practice of sports and activities that can be carried out with this material, without any limit, in terms of regulations, time, regulatory nature, scope or nature, this knowledge being as broad as possible in law.
Third.- That it is responsible for using said material correctly, in accordance with the provisions of the previous section, expressly releasing RKM Balearic Sports SL (Rutas Kayak Menorca) from any liability, including to receive instructions for using the material.
Fourth.- That the assumption of responsibility extends to the use made personally or by any other person, whether this person does it with their permission and knowledge or without it and during the entire period of time in which the rental lasts and until the moment in which the material returns to RKM Balearic Sports SL (Rutas Kayak Menorca), even in the event that said return occurs beyond the agreed rental time.
Fifth.- That he/she confirms that he/she has the basic swimming ability to be able to carry out the activity, an essential requirement according to the internal policy of RKM Balearic Sports SL (Rutas Kayak Menorca). If the client does not comply with this requirement and, even so, decides to carry out the activity, he/she states that it will be under his/her strict responsibility, freeing the company from assuming any responsibility, burden or obligation in any situation in which said ability is required.
Sixth.- That he/she is responsible for wearing the life jacket during the entire activity (Route or Rent by hours), an essential requirement according to the internal policy of RKM Balearic Sports SL (Rutas Kayak Menorca). If the client does not comply with this requirement and, even so, decides to carry out the activity, he/she states that it will be under his/her strict responsibility, freeing the company from assuming any responsibility, burden or obligation in any situation in which said ability is required.
By accepting these terms the client confirms that both, he/she and all the members of the group he/she represents under his/her reservation, have read and accepted the responsibility agreement and instructions for use, in the date of the event of the activity and throughout its duration.
